In response to criticism from some state lawmakers, the state University Board of Regents says undocumented students are allowed to attend Georgia’s public colleges and universities.

14 state senators sent a letter to the Regents this week saying it’s against the law to admit undocumented students into state schools.

It came on the heels of the board’s recent efforts to make sure incoming freshman who are in the country illegally aren’t paying in-state tuition.

Regents spokesperson John Millsaps says they’ve checked with the U.S. Immigration and Customs branch of the Department of Homeland Security, and Georgia is following the law.

“Our policy as to undocumented students is currently in compliance with federal and Georgia law. That means that undocumented students are not precluded from admissions to public colleges and universities, but they are ineligible for state or federal assistance” says Millsaps.

The issue gained the national spotlight last month when an undocumented Kennesaw State University student was arrested and found to be paying in-state tuition.
