Earlier this year, a Fulton County judge ruled a proposed coal fire plant in Early County had an invalid permit. The judge said the state Environmental Protection Division did not properly evaluate carbon dioxide as a source of industrial pollution. The judge's ruling halted construction on the plant, the first to be built in Georgia in 20 years.

Tuesday, an appellate court overturned that ruling. However, that decision will be appealed by a coalition of environmental groups, including the Georgia Sierra Club, meaning building will not continue until the State's high court makes a ruling.
